Initial Treating Provider

The initial treating provider is the first provider that an injured worker sees to receive medical care. As required by Ohio Administrative Code (OAC) 4123-6-028, within one working day of the initial treatment or initial visit, the provider should submit a First Report of an Injury, Occupational Disease or Death (FROI) to either the injured worker’s managed care organization (MCO) or BWC. It is important to note that BWC-certified providers have signed a contract obligating them to adhere to Ohio workers’ compensation laws and rules. Therefore, 24-hour reporting is a legal and a contractual requirement and, as such, non-compliance could result in loss of BWC-certification, removal from a MCO’s panel, or both.
